Supreme Court Jolt To Abu Salem: ‘Did not work for the welfare of the society… has been punished under TADA Act’, Supreme Court shocked gangster Abu Salem

New Delhi. After Bombay High Court, now the Supreme Court has also refused to give relief to gangster Abu Salem. Abu Salem had filed a petition in the Supreme Court seeking release in the 1993 Mumbai bomb blasts case. Abu Salem had argued in the petition that according to the terms of extradition, he could not be sentenced to more than 25 years. In the Supreme Court, the bench of Justice Vikram Nath and Justice Sandeep Mehta refused to hear Abu Salem’s petition. He said that the Bombay High Court will hear the case according to the documents received from Nashik jail.

According to the report of Bar and Bench, the Supreme Court also refused to direct the Bombay High Court for early hearing in the case of Abu Salem. The Supreme Court bench told Abu Salem’s lawyer that you have been punished under the TADA law, not for doing good to the society. The Supreme Court asked Abu Salem’s lawyer as to which order of the Bombay High Court he had come against. Abu Salem’s lawyer Rishi Malhotra said that the Bombay High Court has said that prima facie Abu Salem’s sentence has not been completed for 25 years. On this the Supreme Court said that this is prima facie. For this, apply for interim bail in the Bombay High Court. Abu Salem’s lawyer said that his client has been illegally detained for 10 months. His punishment cannot exceed 25 years.

Abu Salem’s lawyer said that the confusion over 25 years is a mathematical error. He requested the Supreme Court Bench to see the affidavit of the IG of Police filed in the Bombay High Court. On this, the Supreme Court asked Abu Salem’s lawyer whether Nashik Jail has given the report in the High Court. On this he said that yes. On this, the Supreme Court said that if the affidavit has been filed in the High Court, then only it will consider and take a decision. The Supreme Court told Abu Salem’s lawyer that he cannot hear the bail application. Abu Salem’s lawyer said that he has appealed to the Bombay High Court thrice. Ask for early hearing. On this the Supreme Court said that Abu Salem has been punished under TADA. He did not work for the welfare of the society.
