The controversy is over a face cleanser called ‘Lotus Splash’, which was launched under Deepika’s wellness brand 82°E. In this case, cosmetic company Lotus Herbals Private Limited lodged an objection. The company says that ‘Lotus’ is their registered trademark, which they have been using for their beauty and skincare products for a long time. In such a situation, the name ‘Lotus Splash’ may confuse consumers.
What did Delhi High Court say?
The division bench of the Delhi High Court comprised Justice V. Kameswara Rao and Justice Vinod Kumar. He primarily held that there is a prima facie basis in favor of the plaintiff company in the case. The court canceled the order given earlier by the single bench and gave its decision to grant interim relief.
The court said in its order that at present it appears that the name ‘Lotus Splash’ is similar to the registered ‘Lotus’ trademark and is likely to cause confusion among consumers. The court also considered the arguments made under Section 30(2)(a) of the Trade Marks Act, which states that if a word is used only to describe a characteristic of a product, then it will not be considered as infringement. However, the court was not satisfied with this argument at this early stage.

This case once again shows how important brand names are in the business world. Even a small word is associated with an identity built over years of hard work. It is the responsibility of every company to maintain consumer trust and work within the legal framework. At present this order of the court is interim, that is, the final decision is yet to come.
