Patna. The sword has hung on 42 MLAs of Bihar. These also include Bihar Assembly Speaker Prem Kumar and Vijendra Yadav, minister in Nitish Kumar government. Patna High Court has sent notice to 42 MLAs of Bihar on Thursday. Many petitions have been filed in Patna High Court. The candidates who lost the Bihar Assembly elections have alleged in their petitions that the winners hid many facts in the affidavit given at the time of nomination. Many MLAs have been accused of irregularities in voting. Patna High Court has sought answers from all the 42 MLAs after the hearing.

The High Court has also sent a notice to Bihar Assembly Speaker Prem Kumar.

Patna High Court has said that the affidavit given at the time of nomination is an important part of the democratic system. Voters should get information about the background, assets and other information of the candidates in the election. The court said that if the candidates gave wrong information, then it is serious. All 42 MLAs should respond to the notice within the stipulated time. Among the Bihar MLAs to whom the Patna High Court has issued notice are former minister Jeevesh Mishra, RJD’s Amarendra Prasad and JDU’s Chetan Anand. The most shocking matter is the notice issued to Bihar Assembly Speaker Prem Kumar. Now all these MLAs will have to tell the Patna High Court that they had given correct affidavits during the Bihar Assembly elections. If this is found incorrect, their membership may be cancelled.

The Supreme Court has also asked many times not to hide information in the election affidavit.

Candidates contesting in every election including Lok Sabha have to give an affidavit as per Form 25 of the Election Commission. In this affidavit, along with telling about your family, you have to give important information including criminal cases pending against you, assets, debts etc. The Supreme Court has also said many times that under Article 19(1)(A) of the Constitution, voters have the right to know about the candidates. The Supreme Court has even said that the affidavits filed by the candidates in the elections are not just a formality. If a candidate hides information, it will be considered as undue influence.
