Big decision of Supreme Court, refusal to ban construction or naming after ‘Babri’

Delhi. The Supreme Court on Friday refused to entertain a plea seeking direction to ban construction or naming of any mosque or religious structure in the name of Mughal ruler Babar or Babri Masjid.

After the bench of Justice Vikram Nath and Justice Sandeep Mehta expressed reluctance to consider the petition, the lawyer appearing for the petitioner withdrew it. “The petition is dismissed as it has been withdrawn,” the bench said.

The lawyer appearing for the petitioner cited the announcement by suspended Trinamool Congress MLA Humayun Kabir to build a replica of Babri Masjid in Murshidabad district of West Bengal. He said that the petitioner is against the construction of mosques in the name of “invaders” in the country.

The lawyer said Kabir had “announced the construction of Babri Masjid in Murshidabad despite the fact that Babar was an invader.” He said some action should be taken against him (Kabir).

When the bench announced the dismissal of the petition, the lawyer sought permission to withdraw the petition. The plea has requested the Centre, states and other governments to consider the petitioner’s case and direct them to prohibit or impose a ban on the construction, establishment or naming of any mosque or religious structure after Babar or Babri Masjid or similar/derived names throughout India.

The plea seeks direction to the authorities to consider framing appropriate guidelines or issuing circulars and administrative orders to ban the construction of any mosque or religious structure in the name of Babri Masjid, Babar or anyone who invaded India.

In November 2019, the five-judge Constitution bench of the apex court had given a historic verdict in the Ram Janmabhoomi-Babri Masjid dispute case.

The apex court had paved the way for the construction of Ram temple at the disputed site in Ayodhya and directed the central government to allot five acres of land to the Sunni Waqf Board for the construction of the mosque.
