The sourness started from Amitabh Bachchan’s stage? Lawyer reveals new secrets in Rajpal Yadav loan case
New Delhi . Comedian and actor Rajpal Yadav is in the news these days for his much talked about loan and check bounce case. The case of Rajpal, who came out of jail on interim bail, is still pending in the court, but in the meantime his lawyer Bhaskar Upadhyay has made many shocking claims. He alleges that the root of complainant Madhav Gopal Aggarwal’s resentment is an old incident, which is said to be related to Bollywood megastar Amitabh Bachchan.
Bhaskar Upadhyay said while talking to the media that Amitabh Bachchan had arrived as the chief guest during a film launch program in September 2012. According to the lawyer, complainant Madhav Aggarwal wanted to sit with Amitabh Bachchan on the stage, but Rajpal’s team did not allow it. It was told that Amitabh Bachchan had not taken any fee for attending the program, hence the organizers kept the stage management limited. The lawyer claims that this made Aggarwal angry and after this the strictness on the legal front was increased.
The matter reached the Delhi High Court in September 2012, where a stay on the film was demanded. In December 2012, the first check of Rs 60,60,350 was deposited, which was released by the bank. After this, in 2013, a consent agreement was reached between the two parties, under which the old agreement was to be considered invalid. According to the lawyer, a new agreement was prepared in 2016, in which Rs 10.40 crore were stated as outstanding and it was made clear that once the payment was made, the old agreements would not come into force again.
Bhaskar Upadhyay says that a recovery petition was filed in 2016 and Rs 1.90 crore was also given to the complainant. Another guarantor, Anant Dattaram, came forward for the remaining amount. The lawyer claims that Rajpal Yadav offered to mortgage his property worth Rs 15 crore and asked for time to repay the remaining amount, but the complainant rejected the offer.
The matter became more complicated when, according to the lawyer, checks drawn under the third supplementary agreement, which were earlier considered void, were reactivated. In March 2018, the trial court convicted Rajpal Yadav on the basis of an old agreement and imposed a fine of Rs 11.5 crore. After this, in November 2018, the execution court sentenced him to three months. The defense argues that parallel legal processes cannot run in the same case.
In 2019, Rajpal Yadav’s team challenged this order in the Revision Court. However, alleged lapses during the appointment of the new lawyer were also mentioned. According to the lawyer, the matter of payment through mediation was accepted in the court, which is also mentioned in the order. At present, Rajpal has requested the court to hear the case on merit and consider his arguments in detail. The case is still in the judicial process and the final decision is yet to come.
