Having a dustbin next to the house is a violation of the right to live with dignity: High Court

The Delhi High Court ruled in a case that having a public toilet and dustbin next to one’s house is a violation of the right to live a dignified life in a clean and healthy environment under the Constitution. Justice Amit Bansal said that a clean environment is an integral part of a healthy life and lack of a healthy environment hampers the right to live a dignified life.

The court passed the order while hearing a petition filed by a lawyer against unauthorized open dustbins and toilets constructed on the eastern walls of his property. The petitioner contended that about 150 residents of his neighborhood used to throw their garbage at the said place and several requests were made to the Municipal Corporation authorities to maintain cleanliness near the dustbin and toilets, but no action was taken.

The court held that the public dustbin and toilet adjacent to the petitioner’s house was undoubtedly a nuisance and directed the Delhi Municipal Corporation to demolish the same immediately. In the order passed, the High Court said that one of the integral aspects of a clean life is a clean environment. Lack of clean environment violates the petitioner’s right to live a dignified life.

The presence of public toilet and open dustbin right next to the petitioner’s house is a clear violation of his right to life guaranteed under Article 21 of the Constitution, which includes the right to live a dignified life in a clean and healthy environment.
