Trump lost the tariff war in the judgment of six judges, two of them were appointed by the US president himself!

Donald Trump’s tariff policy was declared illegal by the US Supreme Court on Friday. Rejected all the tariffs imposed by him on various countries including India. Six Supreme Court justices ruled against the US president’s tariff policy. The remaining three members of the 9-member bench gave their opinion in favor. Incidentally, two of the six justices who declared Trump’s tariffs ‘unconstitutional’ were appointed by the US president himself.

The Supreme Court explained that under the International Emergency Economic Powers Act of 1977 (International Emergency Economic Powers Act or IEEP), Trump raised the import tariff rate, that law did not give the President this right. It is beyond his control. He cannot impose additional tariffs without the consent of Congress. It should be noted that the law is supposed to be used when a state of emergency is declared in America.

Chief Justice John Roberts wrote in the ruling that the Constitution vests the power to impose tariffs and taxes on Congress. Not the president. Justice Neil Gorsuch, Justice Amy Coney Barrett, Justice Sonia Sotomayor, Justice Elena Kagan and Justice Ketanji Brown Jackson also expressed their opinions. Among them, Justice Gorsuch, Justice Barrett was appointed by Trump.

Calling the ruling disappointing, Trump said, “The decision is wrong. But it doesn’t matter. Very proud of our work.” Even after that, he ordered to impose 10% duty for 150 days in some cases in place of the dismissed duty. He also said that, “I will collect more money from customs in the coming days. This judgment will make it stronger in the future.”
