Neal Katyal vs Donald Trump: America Political and legal debate has intensified regarding the decision to impose 15% global tariff in India. Indian-American lawyer Neel Katyal has strongly criticized this move of President Donald Trump, saying that the President cannot impose such comprehensive tariffs bypassing Congress. Katyal clarified that if Trump thinks this policy is a “good idea,” then he should follow the constitutional process.
This dispute has emerged at a time when the US Supreme Court recently in a 6-3 decision canceled several earlier tariff related decisions of the Trump administration. The court acknowledged that the administration overstepped its authority under the International Emergency Economic Powers Act (IEEPA) of 1977 and reiterated that the original power to impose taxes rests with Congress.
Trump had imposed 15% tariff
Trump announced new tariff measures immediately after the Supreme Court’s decision. First, a temporary global tariff of 10% was imposed under Section 122 of the Trade Act of 1974, which was to be implemented for 150 days. This was later increased to “the fully permitted and legally recognized level of 15%”.
Katyal, who had previously won a landmark case against Trump’s trade measures, raised serious questions about the use of Section 122. He says that the Department of Justice (DOJ) had earlier argued in court that Section 122 does not apply in cases related to trade deficit, because trade deficit and balance of payments deficit are different concepts.

He further said, “If he wants to impose blanket tariffs, he should adopt the American way and go to Congress. If his idea of imposing tariffs is so good, he should have no problem in convincing Congress. That’s what our Constitution says.”

Geeta Gopinath, former first deputy managing director of the International Monetary Fund (IMF), also supported Katyal’s analysis. He said that trade deficit and balance of payments deficit are not the same and both should be viewed in different legal contexts.
