Uttar Pradesh Congress President Ajay Rai on Monday wrote an open letter in favor of Shankaracharya of Jyotirpeeth, Swami Avimukteshwarananda Saraswati, saying that the hunters of power should stop trying to suppress the voice of saints. Uttar Pradesh Congress President has written a letter to Prime Minister Narendra Modi demanding a fair and transparent investigation into the ‘POCSO case’ registered against Jyotishpeeth’s Shankaracharya Swami Avimukteshwaranand ji.

He said that this action was taken when Swamiji had cornered the state government over the irregularities in the Kumbh Mela, which directly smacks of ‘political vendetta’. Congress clearly believes that the religious autonomy granted under Articles 25-26 and the orders of the Supreme Court should be respected. Making the dignity of any spiritual position a weapon of political rivalry is against both democracy and the Constitution. We demand that this should be investigated by an independent or central agency so that milk can be separated from water.

Ajay Rai wrote that you must be aware from the information published in various news media recently that an FIR has been registered under the POCSO Act against Shankaracharya Swami Avimukteshwaranand Saraswati of Jyotirmath Peeth. It is also stated that the said FIR was registered in compliance with the directions of the Court. It is the duty of every citizen and government to respect the orders of the court, however, the circumstances and the broader perspective of this case have raised serious questions and apprehensions in the society.
He wrote that you would be well aware that Swamiji had earlier publicly raised questions on the administrative arrangements of the state government in the context of the stampede that took place in the Maha Kumbh Mela. Subsequently, the incidents of him being stopped from bathing in the Magh Mela and alleged misbehavior with the Batukas accompanying him also came to light, which were widely criticized. In such a perspective, the timing of the current criminal proceedings has naturally become a topic of public discussion.
It is also extremely important that there be an impartial investigation into the background, circumstances and possible motivating factors of the persons filing the FIR. If this case is the result of a completely legal and independent criminal process, then the truth will automatically be established through a transparent investigation, but if there is a suspicion of any kind of political motivation, pressure or malice behind it, then it is equally important to resolve it in time. In such a situation, if necessary, only an investigation supervised by an independent or central agency can strengthen public trust.

Articles 25 and 26 of the Indian Constitution provide religious freedom and the fundamental right of religious communities to manage their religious affairs. The post of Shankaracharya is one of the highest spiritual posts in the Sanatana tradition, whose recognition and tradition are determined by historical religious traditions. In this context, many decisions of the Honorable Supreme Court are guiding. In which the Court propounded that if prima facie the criminal proceedings appear to be malicious or vindictive, then judicial intervention is justified. The Supreme Court made it clear that criminal law cannot be used as an instrument of repression or retaliation.
It is clear that dissent or criticism cannot be suppressed by punitive power. In the light of the above constitutional principles, it is extremely important that the criminal process be fair, independent and completely free from political influence, that the dignity of religious office or its validity should not be mixed with criminal disputes and that state power should not be used as a tool to influence any spiritual leadership or damage its reputation.
Prime Minister, if the circumstances arising against a top religious leader give the impression that there is an unnecessary conflict between governance and spiritual tradition, then this may give rise to a feeling of dissatisfaction and pain in the wider religious society. Timely resolution of any such apprehension is necessary from the point of view of democratic balance and social harmony.
A question is being raised in the Indian society whether the actions being taken by the Uttar Pradesh government under the leadership of Yogi Adityanath are motivated by unnecessary harshness or vindictive sentiments. If so, then it not only tarnishes the image of the state. In fact, the governance capacity of the Central Government may also be questioned. It is extremely important to resolve any such notion in time. This topic is not just about a particular person, but is related to faith, constitutional rights and impartiality of governance. The people of the country want to believe that the rule of law is supreme in India and any kind of abuse will not get protection.
