Allegations Against Ashutosh Brahmachari Deepen Controversy

Who is Ashutosh Brahmachari: astrology bench Shankaracharya Swami Avimukteshwarananda Saraswati And Ashutosh Pandey, who lodged an FIR against his disciple Swami Mukundanand Giri, is currently in the headlines. Ram Shankar Dixit, resident of Shahjahanpur, has made serious allegations against him. Dixit claims that Ashutosh Pandey has contacted him and tried to instigate him to make false allegations against Swami Avimukteshwarananda.

According to Ram Shankar Dixit, three people came to him and made him talk to Ashutosh Pandey on the phone. He said that Swamiji needs some ‘fixing’ and talked about filing a complaint against him in the name of his minor daughters. On this, Dixit refused and said – How can you say such things about my daughters… I myself Shankaracharya I have met G. I have not made any allegations against Shankaracharyaji.

Swami Avimukteshwarananda What did Saraswati say?

Swami Avimukteshwarananda Saraswati also claimed that a family from Shahjahanpur met him and told that a person named Ashutosh Maharaj pressurized him to file a complaint against him in the name of his minor daughters. When he refused, he was threatened. Swamy said that an attempt is being made to create an atmosphere against the people by showing them greed and fear.

Who is Ashutosh Brahmachari?

  • Ashutosh Maharaj (also known as Ashutosh Brahmachari), who filed the FIR against Shankaracharya Swami Avimukteshwarananda of Jyotish Peeth, is a disciple of Shakumbhari Peethadheeshwar and Jagadguru Rambhadracharya. His real name is Ashutosh Pandey.
  • Ashutosh is associated with the ancient Shakumbhari Siddhapeeth temple located in Kandla of Shamli district. He is currently Shakumbhari Peethadhishwar. It is said that he took initiation from Jagadguru Rambhadracharya during Mahakumbh in 2022.
  • Ashutosh Maharaj has accused Swami Avimukteshwaranand and his disciple Swami Mukundanand Giri of sexually exploiting minor children at the Magh Mela camp in Prayagraj. On his petition itself, the POCSO court of Prayagraj has ordered to register an FIR.
  • Swami Avimukteshwaranand has called Ashutosh Brahmachari a ‘history sheeter’. According to reports, several cases are registered against him in various districts of Uttar Pradesh (Shamli, Muzaffarnagar, Lucknow etc.), which include fraud and other serious charges.

Under which sections is the case registered against Swami Avimukteshwaranand and his disciple?

The special POCSO court of Prayagraj has ordered to register an FIR under serious sections against Shankaracharya Swami Avimukteshwaranand and his disciple Mukundanand Giri. These include,

  • POCSO Act: Sections 3, 5, 9, 17 and 18. These sections mainly relate to ‘penetrative sexual assault’ (aggravated sexual assault) and incitement to commit a crime.
  • Indian Judicial Code (BNS): Sections 69, 74, 75, 76, 79 and 109. These sections relate to sexual exploitation, insulting the dignity of woman/child and criminal conspiracy.
  • Nature of charge: It has been alleged in the FIR that minor children (aged around 14-17 years) were sexually exploited in the name of ‘Guru Seva’ in the Ashram/Gurukul.

What action has been taken so far?

  • Special Judge Vinod Kumar Chaurasia has ordered Jhunsi police station in-charge to immediately register an FIR and start an impartial investigation. The court has also asked to examine the pen drives and affidavits which were presented as evidence.
  • The sections of POCSO are non-bailable and there is no provision for anticipatory bail. Therefore, according to legal experts, there remains a possibility of arrest on the basis of police investigation.
  • Swami Avimukteshwarananda has called all these allegations ‘false and fabricated’ and termed it a conspiracy to suppress the voice of mother cows.
