New Delhi. The Supreme Court on Wednesday rejected a plea seeking a ban or change in the name of the upcoming film ‘Yadav Ji Ki Love Story’, saying the name does not portray the Yadav community in any derogatory manner. Justice B.V. A bench of Justice Nagarathna and Justice Ujjal Bhuyan dismissed the petition filed by the head of the organization ‘Vishwa Yadav Parishad’.
The bench studied the material on record and found that the main complaint was that the name of the film misrepresents the Yadav community in the society. “Therefore, it is being argued that the name of the film should be changed,” Justice Nagarathna said. We are unable to understand how the title of the film can portray the community in a derogatory manner. There is no adjective or word anywhere in the title of the film that reflects the Yadav community in a negative light.
The bench termed these apprehensions as “completely baseless” and explained its earlier order in a similar case related to ‘Ghooskhor Pundit’ in which the court had directed the producer to change the title of that film. The order states, “The word ‘bribery’ has the meaning of corrupt. Therefore this title was depicting the community in a negative sense. In the present case there is no such negative connotation attached to the Yadav community.
No reasonable restrictions apply under Article 19(2) of the Constitution (reasonable restrictions on freedom of speech and expression). This name does not in any way portray the Yadav community in a wrong or negative light. Therefore, the writ petition is dismissed.” The petitioner had alleged that the title of the film promotes an objectionable stereotype towards the community. The petition expressed concern over the portrayal of the female lead character.
During the hearing, the petitioner’s lawyer argued that he does not oppose inter-community marriages but the portrayal of a woman in the film is unacceptable. “A woman cannot be publicized like this,” the lawyer said, adding that the film claims to be based on a true incident. However, the judge did not agree with this and termed the film as a work of fiction.
