‘We do not understand this community by name…’ Supreme Court rejected the petition filed against Yadav Ji Ki Love story
Supreme Court Dismisses Petition Against Yadav Ji Ki Love Story: The Supreme Court on Wednesday refused to ban the release of the film ‘Yadav Ji Ki Love Story’ and completely rejected the petition related to it. This decision of the court has come just two days before the nationwide release of the film. The court clarified that the title of the film does not contain any word or adjective which negatively impacts the image of the Yadav community or portrays them in a wrong manner.
The court ruled in favor of the film
Justice B.V. The bench comprising Nagarathna and Ujjwal Bhuyan said during the hearing that the apprehensions expressed by the petitioner are completely baseless. The court questioned how the title of the film could misrepresent a community? The petition alleged that the use of caste-based addresses like “Yadav ji” risks disturbing social harmony and reinforcing caste stereotypes. However, the court ruled in favor of the film, calling it fictional.
Court gave example of ‘Bandit Queen’
During the hearing, the court also gave the example of the case of the famous 1994 film ‘Bandit Queen’. At that time also there was controversy regarding the portrayal of Gurjar community, but the court had kept it within the scope of freedom of expression. When the petitioner’s counsel raised questions over the portrayal of the woman in the film and its being based on a true incident, the bench clearly said that the film is a fictional cinematic work and after studying the material on record, nothing objectionable has been found in it.
There has been an uproar over ‘Ghushkhor Pandit’ too.
The Supreme Court also clarified the difference between the previous order given on Netflix’s film ‘Ghushkhor Pandit’ and this case. The court said that the word ‘Ghushkhor’ means ‘corrupt’, which was associating a negative adjective with a community, hence action was taken against it. On the contrary, in ‘Yadav Ji Ki Love Story’ there is no derogatory word associated with the Yadav community. The court said that there is no need for appropriate restrictions to be imposed under Section 19(2) of the Constitution.
settlement of dispute
Let us tell you that earlier on February 19, filmmaker Neeraj Pandey had decided to withdraw the title and promotional material of ‘Ghushkhor Pandit’, after which that controversy ended. In the case of ‘Yadav Ji Ki Love Story’, the bench has expressed the hope that after this clarification from the court, the ongoing controversy regarding the title will come to an end. Now this film will be released in theaters on its scheduled time without any legal hindrance.
