AJL and former CM Bhupinder Singh Hooda got big relief from HC, court quashed the charges… gave clean chit.

Punjab and Haryana High Court, while giving a major decision on Wednesday, has ended the ongoing criminal case against former Chief Minister Bhupinder Singh Hooda and Associated Journals Limited (AJL). The division bench of Justice Tribhuvan Dahiya accepted that there was no rigging in the re-allocation of Panchkula plots. This historic decision is being seen as a big victory for Hooda.

The court gave an important decision

Let us tell you that the court made it clear in its detailed order that the decision taken by the then Chief Minister Bhupinder Singh Hooda in the year 2005 was completely legal. This decision was unanimously approved in the meeting of Haryana Urban Development Authority (HUDA) in 2006. The High Court said that till date no court has declared this allocation illegal. so. It is unfair and against the law to consider it a criminal conspiracy without any solid evidence.

Corruption allegations cannot be made

Justice Dahiya’s bench said that AJL had paid the entire amount fixed for re-allotment and extension fees on time. The company had also completed the construction work on the allotted plot. On the basis of which, in August 2014, the authority had also issued him an occupation certificate. When the owner of the property has fully complied with all the legal procedures and has obtained the certificate. So corruption charges cannot be leveled against him.

The most important aspect in this case was the claim for financial loss. Which was completely rejected by the court. The court found that no complaint of any loss was lodged with the authority. Even the government auditors had now withdrawn their initial objections. The court said that criminal prosecution cannot be initiated by estimating imaginary loss only on the basis of market price. It is clear from this that there was no loss to the government treasury.

CBI had filed charges in this case under the Prevention of Corruption Act. After which the trial court framed charges in 2021. Although. The High Court took a tough stance and said that the evidence presented by the CBI does not even prima facie corroborate the allegations. The court said in clear words that continuing the prosecution in this case would only be an abuse of the judicial process. Therefore, orders have been given to acquit all the accused in this case with immediate effect.

Big relief for Hooda

This decision is extremely important for Hooda’s political future as no concrete evidence of conspiracy or fraud has been found. The court acknowledged that it is not justified to give a criminal color to administrative decisions without any basis. Hooda’s supporters welcomed this decision and called it a victory of truth. The happy end of this long-running legal battle has brought great relief to the former Chief Minister and AJL. Due to which his image has become spotless.
