Patna. In view of the problem of land related cases pending for years in Bihar, the state government has taken strict administrative steps. Now it has been made mandatory to settle land disputes within the stipulated time. The Revenue and Land Reforms Department has issued instructions saying that under normal circumstances, any land dispute should be settled within three months.
Change in definition of ‘pending’ cases
The biggest change the government has made is in the definition of the word ‘pending’. Now a case will be considered pending only if a stay order or temporary injunction has been issued by the competent court under the Civil Procedure Code, 1908. This means that it will no longer be possible to hold files without any legal restrictions. In case of delay in such cases, accountability of the concerned officers will be fixed.
Weekly review will be mandatory
Principal Secretary of the Revenue Department, CK Anil has instructed all the Divisional Commissioners, District Magistrates and Land Reform Deputy Collectors to review land matters regularly on a weekly basis. Its objective is to ensure that the stipulated timelines are followed and there is no negligence at any level.
Time limit fixed for different cases
Time limits have again been strictly enforced for disposal of various types of cases pending in Revenue Courts.
Cases related to filing-dismissal, appeal, jamabandi cancellation, rent determination, sharing and encroachment: 30 to 90 days
Land Cessation and Other Administrative Matters: Within the prescribed period
Technical work like geodesy: Within about one to one and a half weeks
The purpose of this system is that disputes should not drag on for a long time due to land measurement or paper process.
Monitoring will be done through digital monitoring
The state government has further tightened monitoring through digital platforms. The progress of cases registered on Bihar Bhumi Portal and RCMS Portal is being monitored from the headquarters. Deputy Chief Minister cum Revenue Minister Vijay Kumar Sinha has clearly said that delay in land related matters directly affects the rights of the common citizen. Therefore, strict action will be taken against officials showing unnecessary delay or indifference.
