Avimukteshwarananda will not be arrested now, big relief from High Court
Swami Avimukteshwaranand Saraswati is once again at the center of controversies. In the case of sexual exploitation registered in Prayagraj, legal action against him had intensified and the possibility of arrest had increased. However, in the latest developments, Allahabad High Court has given them a big relief. After hearing the arguments of both the parties, the court has reserved its decision and till then has put a stay on the arrest.
What are the allegations?
Allegations of sexual exploitation in the ashram have been made by some Batuks. On the basis of the complaint, the police registered a case and started investigation. Medical examination has revealed that harassment has been confirmed, which makes the matter more serious. Meanwhile, Swami Avimukteshwaranand and his disciple Mukundanand Giri approached the High Court for anticipatory bail.
What happened in the court?
The case was heard in the bench of Justice Jitendra Kumar Sinha. During the hearing the court room was packed with lawyers. The court asked why the application was not filed in the Sessions Court first and why it came directly to the High Court? The court also questioned the police as to where are the alleged victim children and what is the status of their statement.
While opposing the bail, the state government said that Shankaracharya is an influential person, hence if he is given relief, the investigation may be affected. The defense side argued that the case was false and fabricated. A batuk’s mark sheet was presented and he was declared an adult and the alleged criminal background of the complainant was also mentioned.
Ban on arrest, instructions to cooperate in investigation
While reserving the order, the High Court made it clear that no arrests will be made until the final decision is taken. Also, Swami Avimukteshwarananda and his disciple have been instructed to cooperate fully in the police investigation. This means that the police can continue the investigation and investigation, but no arrests will be made at this time.
Now what next?
Now everyone’s eyes are on the final decision of the High Court. If the court grants anticipatory bail, Swamy can get huge legal relief. At the same time, if the application is rejected then the possibility of arrest may increase again. Currently, the case is going through the legal process and the investigating agencies will decide further action based on the evidence.
