Supreme Court On COVID-19 Vaccine Side Effects: Government should make ‘no-fault compensation system’ regarding the side effects of COVID-19 vaccine, Supreme Court gave instructions

New Delhi. While hearing the petition filed regarding the side effects of Covid-19 vaccine, the Supreme Court has given a big direction today. The top court said that the government should create a ‘no-fault compensation system’. Under this, if anyone suffers serious side effects or dies due to the Corona vaccine, compensation will be ensured to those people. The court also said that whatever existing mechanism is working to monitor adverse events occurring after Covid vaccination will continue to work, there is no need to form a separate committee for this.

Let us tell you that ‘No-Fault Compensation System’ is such a compensation policy, in which in case of accident or medical loss like side effects of the vaccine, the victim gets immediate compensation without having to prove the fault. While disposing of a petition, the Supreme Court bench of Justice Vikram Nath and Justice Sandeep Mehta made it clear that preparing the no-fault compensation framework does not mean that the Central Government or any other authority has accepted any responsibility or fault. Also, after this decision, it will not happen that the legal options for any victim will be closed. If necessary, the victim can file an application in the court.

The Supreme Court Bench has also said that data related to the side effects of vaccination can be released from time to time so that correct information is available to the people and transparency is maintained in this regard. This petition has been filed in the Supreme Court on behalf of the parents of two girls. The petitioner couple says that both their daughters died untimely due to the side effects of the Covid-19 vaccine. It was also demanded in the petition that all the people who have died suddenly across the country after Covid vaccination should be investigated. For this, an independent committee should be formed so that the side effects of Covid vaccination can be made public.
