Supreme Court On UCC: ‘The time has come to consider UCC’, the Supreme Court said a big thing while hearing the succession related provisions of Shariat.

New Delhi. While hearing the Muslim Personal Law (Shariat) Application Act of 1937, the Supreme Court on Tuesday said a big thing on the Uniform Civil Code. In the Supreme Court, CJI Surya Kant, Justice Jaimalya Bagchi and Justice R. Mahadevan’s bench said that now the time has come to consider Uniform Civil Code i.e. UCC in the country. The court also said that the issue of repealing the sections of Shariat law is sensitive. On which only the legislature can take the final decision.

A petition related to Muslim personal law came before the Supreme Court bench. In which the provisions of Shariat have been described as discriminatory against Muslim women. While hearing this petition, the Supreme Court said that if we cancel the succession provisions of Shariat law, it may create a legal vacuum. Explaining the reason for this, the court said that there is no other clear law governing Muslim succession. CJI Surya Kant told the lawyer of those who filed the petition that it would not be right to take such a step while showing haste in the reforms, which would give women less rights than the existing ones.

The CJI asked that if the Shariat law of 1937 is abolished, what system will be applicable in its place? At the same time, Justice Bagchi, who was part of the bench, said that the issue of discrimination has been raised strongly in the petition, but it would be better for the Parliament to decide in this regard. Because in the Constitution the responsibility of implementing the Uniform Civil Code has been given to the legislature. The court said that many times it has recommended the Parliament to consider implementing a Uniform Civil Code. Petitioner’s lawyer Prashant Bhushan told the court that it can declare that Muslim women should also get equal inheritance rights as men. He demanded the Supreme Court to implement succession law in place of the provisions of Shariat.
