Kanpur POCSO Case: If brother-in-law molests sister-in-law in dream, he gets 7 years jail
After seven years, the court has given a big verdict in a famous case of molestation of minor sister-in-law in Kanpur. POCSO court acquitted Air Force personnel Anurag Shukla of all charges. In the court, the victim retracted her earlier allegations and said that the incident she had narrated was not reality but a dream.
In this case, after the FIR registered in the year 2019, the Air Force personnel was arrested and sent to jail and he had to stay in jail for about 19 days. But when the statements of the victim, her father and elder sister were recorded in the court, the direction of the entire case changed and ultimately the court acquitted the accused.
What was the whole matter?
Anurag Shukla, an Air Force personnel living in Bithoor, was married to a girl from Bidhnu on 10 February 2019. A few days after the marriage, he went to his in-laws’ house to take his wife. At the same time his minor sister-in-law had also come home with him.
According to the FIR, at around 9 pm on March 8, 2019, the minor girl suddenly started screaming loudly. When her elder sister reached the room, the girl alleged that her brother-in-law caught her while she was sleeping and molested her. After this the family informed the police and the matter reached the police station.
What did the sister-in-law say in the court?
During the hearing of the case, when the victim’s statement was recorded in the court, she made a shocking revelation. She said, ‘That night I was lying down after taking medicine. In the dream I felt as if brother-in-law had caught hold of me. I made noise again. My sister came and I went to the hospital. It was a dream, it didn’t really happen.” The victim told that at that time she was sleeping after taking antibiotics and in her half-sleep state, she got confused. Due to this, she raised an alarm and the family felt that something had really happened to her.
When did the police arrest the accused?
On the complaint of the victim’s father, a case was registered at Naubasta police station on 3 August 2019. After this, on 29 September 2019, the police arrested Air Force personnel Anurag Shukla and sent him to jail. After being in jail for about 19 days, he got bail on 17 October 2019. At the same time, the police had also filed a charge sheet based on the initial statements of the victim.
What charges were leveled against the accused?
Four serious charges were framed against the accused in the POCSO court, which included-
- assault on victim
- to defame him
- to molest
- sexual assault
However, when the statements of the victim and her family came out during the hearing, the allegations could not be proved.
Why did the court acquit the accused?
According to defense lawyer Karim Ahmed Siddiqui, the victim clearly said in the court that the incident that happened to her was not real but a dream. Apart from this, the girl’s father and elder sister also admitted in the court that they had filed the case out of confusion. On the basis of these statements, the court found that the allegations against the accused are not proved. After this the court acquitted Air Force personnel Anurag Shukla of all charges.
What allegations did the accused make against his father-in-law?
After the verdict, Air Force personnel Anurag Shukla made serious allegations against his father-in-law. He says that within a few days of marriage, his father-in-law started pressurizing him to transfer his property to his wife and her sister. Anurag alleges that when he refused to do so, a false case was registered against him. He said that due to this case, he had to face mental stress, got defamed in the society and even his job promotion was affected.
