Only NIA will investigate Murshidabad violence case, Bengal government’s petition rejected

New Delhi . The Supreme Court has refused to stay the Calcutta High Court’s order to conduct a National Investigation Agency (NIA) investigation into the violence in Murshidabad in January. A bench headed by Chief Justice Surya Kant said that the High Court has adopted a balanced approach in this matter.

During the hearing, lawyer Kalyan Banerjee, appearing for the West Bengal government, said that the High Court’s order to conduct an investigation by the NIA is contrary to the February 11 order of the Supreme Court. On February 11, the Supreme Court had directed the Calcutta High Court to investigate whether there was a need for a further investigation by the NIA into the violence that took place in Beldanga on January 16-17. On February 11, the Supreme Court had directed the NIA to submit the sealed report of the case to the Calcutta High Court.

During the hearing, Justice Joymalya Bagchi said that the purpose of the February 11 order was that the High Court should decide on the basis of available material whether the provisions of UAPA are applicable or not. For this it is necessary to see the material related to the investigation.
