‘What happened is unusual and not right’, Supreme Court expressed displeasure over Mamata Banerjee’s role in IPAC-ED raid
Tezzbuzz Desk – An important hearing was held in the Supreme Court on Wednesday in the ED raid case related to IPAC, where the state government once again sought time. On this, the court took a strong stand and said that sufficient time has already been given and now delay will not be tolerated.
Court angry on asking for time
Senior advocate Kapil Sibal, appearing for the state government, sought additional time before the bench of Justice Prashant Kumar Mishra and Justice NV Anjaria.
However, Tushar Mehta opposed this and said that it is just an attempt to waste time, whereas there are serious allegations against the Chief Minister in the case.
Question on Mamta Banerjee’s role
During the hearing, the court made strict remarks on Mamata Banerjee’s presence during the ED raid. The court said that whatever happened is “abnormal” and such a situation cannot be considered normal.
‘Already got 4 weeks’ time’
The court reminded the state government that it had already been given 4 weeks time to file its reply. On this Sibal said that he wants to file his reply.
While discussing the rights of ED and investigating agencies, it was said that investigation is a right given by law, not a fundamental right.
‘Interference in investigation unusual’
Solicitor General Tushar Mehta argued that it was highly unusual for the Chief Minister to interfere in the investigation of a central agency in this manner. He said that it is not appropriate to ask for time even after 4 weeks.
Question on entry of third person during search
ED said in its affidavit that the search had to be stopped to avoid a confrontation between the state police and central forces. The agency also clarified that during any investigation, no third person can be allowed to come inside or take away the goods.
