Nitish Kumar Resignation Plan: There is a discussion in full swing about when JDU President and elected Rajya Sabha MP Nitish Kumar will resign from the post of Chief Minister of Bihar. However, media reports are claiming that he will not leave his post suddenly. Nitish, who has been leading Bihar for almost two decades, will leave his responsible posts in two installments one by one. Sources say that Nitish will first resign from the membership of Bihar Legislative Council.
According to the law of the country, Nitish is required to resign from the post of MLC by March 30, otherwise his Rajya Sabha membership will automatically end before it starts. His tenure in Rajya Sabha can start from April 10, so till then he can leave the post of MLC and remain the Chief Minister of Bihar. Nitish Kumar may resign from the post of CM in the second week of April, when the time for him to take oath as Rajya Sabha MP will come near.
Mandatory to resign within 14 days
According to Article 101 of the Indian Constitution, Prohibition of Simultaneous Membership Rules 1950 and Section 70 of the Representation of the People Act 1951, a person can be a member of only one of the Parliament and the Legislative Assembly at a time. If a member of the State Legislature is elected as an MP, he has to submit his resignation from membership to the Speaker or Chairman of the House of the Legislature within 14 days of being declared elected. If he does not resign within the stipulated time, the seat in Parliament for which he has been elected will automatically become vacant.
NDA meeting regarding CM
It is likely that in the second week of April Nitish Kumar Apart from BJP, JDU, there should be meetings of MLAs of NDA constituents LJP-R, HAM and RLMO to select the new Chief Minister to replace him. First, each constituent party will elect the leader of its respective legislative party. If Nitish, who is leaving the power of Bihar, wants, before going to Delhi to take the oath of Rajya Sabha MP, he should install a new CM on the Chief Minister’s chair or complete the formalities of transfer of power after returning to Patna after becoming an MP.
