There is no compulsion to sing ‘Vande Mataram’, Supreme Court rejected the petition and said – it is just an advice

New Delhi exposed. The Supreme Court bench led by the country’s Chief Justice Justice Surya Kant on Wednesday (25 March) flatly refused to hear the petition filed regarding ‘Vande Mataram’. The court said that the guidelines issued by the Central Government are only advisory and not a mandatory rule, hence the matter is “premature” at the moment. Justice Joymalya Bagchi and Justice Vipul M. Pancholi were also included in this bench. The court clearly said that there is no provision for any punishment or action for not following these guidelines, hence no one is being forced to sing ‘Vande Mataram’.

The petition was filed by Mohammad Saeed Noori, on whose behalf senior lawyer Sanjay Hegde appeared. He argued in the court that even though these rules are advisory, there can be pressure in the society and people can be forced to sing under compulsion. He said that patriotism cannot be imposed forcefully. On this the court raised the question whether anyone is really being punished for not singing ‘Vande Mataram’? Is anyone being kicked out of the program? The court said that until such a concrete example or case of punitive action comes to light, there is no need to hear this issue.

The Supreme Court also said that the word ‘may’ has been used in the guidelines, which makes it clear that it is not mandatory. This means that if someone wants to sing, he can sing and if he does not want to sing, there should be no pressure on him. Overall, the court’s message is clear—at this point it is just advisory, not law. Unless a case of forceful enforcement or punishment comes to light, the court will not interfere.
