Opposition’s impeachment motion fell with a thud; Chief Election Commissioner Gyanesh Kumar’s tenure will continue
Impeachment Motion Gyanesh Kumar CEC Reject: The Rajya Sabha Chairman has rejected the impeachment motion brought by 193 MPs against Chief Election Commissioner Gyanesh Kumar. After a thorough discussion on this proposal, which was moved on March 12, the Chairman, using his powers under Section 3 of the Judges (Inquiry) Act, 1968, refused to accept it.
After this decision, it has become clear that the tenure of the Chief Election Commissioner will be safe and the process of impeachment against him will not proceed further. This decision is being considered important in the context of independence of the election process and strength of constitutional institutions.
Chairman’s decision and legal basis
The Chairman of Rajya Sabha took this decision after objectively evaluating all aspects of the proposal. He said that it is not appropriate to proceed with the impeachment proceedings on the basis of available facts and allegations. Under Section 3 of the Judges (Inquiry) Act, 1968, he has the right to accept or reject such proposals at the initial stage itself. It was through this process that they rejected the proposal, eliminating the need for further investigation or parliamentary action.
Opposition’s allegations and issues
The opposition parties had given notices in both the Lok Sabha and Rajya Sabha houses demanding the removal of the Chief Election Commissioner from the post. Seven serious charges were leveled against him, which included issues like bias, discrimination, misconduct, electoral fraud and influencing voting rights. Questions were raised about the Special Intensive Revision (SIR) campaign of voter lists, especially in Bihar and West Bengal. The opposition claimed that due to this process, names of many voters were removed from the list, affecting their voting rights. Apart from this, allegations like working in favor of some political parties and benefiting BJP were also made. In support of which some decisions of the Supreme Court were cited.

Meaning of the decision and the way forward
After this decision of the Chairman, it has become clear that the impeachment process against the Chief Election Commissioner will not proceed further and he will continue in his post.
