Don’t blame judges alone for pendency of cases: Justice Amanullah
Bureau Prayagraj. Supreme Court Justice Ahsanuddin Amanullah on Saturday said judges alone cannot be held responsible for the rising number of pending cases in India. He said the delay in justice is often influenced by the way lawyers argue and the legal process.
Justice Amanullah said, “There is no direct relation between the number of judges and the rate of disposal of cases. It depends on the lawyers how long they want to argue.” He said that lawyers and people associated with the legal profession should also introspect about the delay in the justice system.
He said that habits like having long arguments and taking repeated dates cause delay in disposal of cases, hence it is necessary to consider and improve these.
Speaking at ICA’s fifth international conference on ‘Arbitration in the Age of Globalization’, Justice Amanullah said judges already hear a very large number of cases every day.
“At the lower court level, no judge has a list of less than 400-500 cases per day,” he said. This number is even higher in the High Courts.
He said that although judges are mandated to sit in court for fixed hours and hear the cases listed before them, they cannot always reduce the time spent on arguments by lawyers.
Justice Amanullah said that although judges may sometimes prevent lawyers from repeating their arguments, they are committed to allowing them to present their case fully.
