Kejriwal’s big attack in Delhi High Court: Serious questions raised on the impartiality of the judge

What happened today in Delhi High Court not only gave rise to a legal debate but also gave a big political message. Aam Aadmi Party’s national convenor Arvind Kejriwal himself appeared in the court without a lawyer and presented his arguments with full confidence. On the basis of facts, law and his own arguments, he tried to explain why questions are being raised on judicial impartiality in this case. Raised serious questions on fairness

Putting forward 10 big points before the court, Kejriwal said that the impartiality of Justice Swarnakanta Sharma, who is hearing this case, is doubtful. He demanded that the judge should recuse himself from the case so that the process of justice remains transparent.

 

Delhi news: Order without listening to the accused

He said that no accused was present in the hearing on March 9 and only the arguments of the CBI were heard. Despite this, the court declared the order of the Sessions Court prima facie wrong. Kejriwal raised the question that how can such a conclusion be drawn without listening to the other side.

Kejriwal also alleged that Justice Swarnakanta Sharma stayed the ED proceedings without any official demand. Besides, the order to take action against the investigating officer of CBI was also stopped by the Sessions Court, while the concerned officer had not even made any appeal against it.

 

Accusations of short time and bias

He said it was unusual to be given only a week’s time to respond to a 600-page document, whereas in other cases months are given. Apart from this, the use of strong words like declaring the accused guilty during the bail hearing itself also raises questions on the judicial process.

 

Supreme Court and allegations of bias

Kejriwal said that the Supreme Court has given relief to the accused by rejecting many decisions of Justice Swarnakanta Sharma. He also alleged that the judge’s orders appear to be inclined in favor of the CBI and ED, thereby casting doubt on a fair trial.

 

Questions on family and political connections

Delhi news: Kejriwal raised questions on the judge’s impartiality, citing his family ties and alleged participation in RSS-related events. Also questioned the statement of Union Home Minister Amit Shah, in which he had already indicated the direction of the High Court’s decision.
