High Court stays NCLT order, investigation of cases filed in Allahabad will now take place there

The Allahabad High Court partially stayed the order of the Principal Bench of NCLT, New Delhi, which had directed joint investigation of the petitions and applications filed in the Allahabad Bench. The division bench of Justice Ajit Kumar and Justice Indrajit Shukla made it clear that the petitions filed in Allahabad will be examined only by the registry there, with the Central Government counsel seeking four weeks’ time to take instructions. The matter came to light during the hearing of a petition filed by the Company Law Bar Association.
The petition challenged the public notice issued on February 27, 2026, in which the Registrar of the Principal Bench of the National Company Law Tribunal (NCLT), New Delhi, directed that the cases filed in the Allahabad Bench would be jointly investigated. The petitioners said that due to this order, documents were being physically filed in Allahabad, while online filing was being done in the Principal Bench of New Delhi.
Due to this, since February itself, objections were being repeatedly raised in the files by the Registry of the Principal Bench and the shortcomings were not being removed. It was also argued that only the Allahabad bench was targeted in this arrangement. During the hearing, the High Court questioned the defendants that when the petitions are being filed in Allahabad, why should they be examined by any other bench. The next hearing of the case will be scheduled later.
