Supreme Court reserves decision on Pawan Kheda’s anticipatory bail plea

Bureau Prayagraj. The Supreme Court on Thursday reserved its decision on the anticipatory bail plea of ​​Congress leader Pawan Kheda. This case is related to the allegations leveled against Riniki Bhuyan Sarma, wife of Assam CM Himanta Biswa Sarma.

Pawan Kheda had alleged that the Assam Chief Minister’s wife holds multiple passports and has undeclared properties abroad. Following these allegations, Riniki Bhuiyan Sharma filed a criminal case against Kheda and others under various sections of the Indian Justice Code at the Guwahati Crime Branch police station.

The bench of Justice JK Maheshwari and Justice AS Chandurkar reserved the decision after hearing the arguments of both the sides. During the hearing, senior advocate Abhishek Manu Singhvi, appearing for Kheda, argued that the allegations against his client are the subject of trial and there is no need for arrest.

He said that many of the sections under which the case is registered are bailable and in the rest also arrest is not necessary, hence it would not be appropriate to deny anticipatory bail. Singhvi also argued that if anticipatory bail is not granted in such cases, the very purpose of this legal provision would be defeated.

At the same time, Solicitor General Tushar Mehta, appearing for the Assam government, opposed the petition and said that Kheda has presented fake and tampered documents related to the passport of the Chief Minister’s wife. He also alleged that Kheda is evading investigation and propagating wrong facts by continuously releasing videos. Mehta told the court that all the allegations made against the Chief Minister’s wife were baseless and false.

Pawan Khera has challenged in the Supreme Court the order of Gauhati High Court refusing to grant anticipatory bail on April 24. Earlier, the Telangana High Court had granted him transit anticipatory bail of seven days, but on the appeal of Assam Police, the Supreme Court put an interim stay on this relief and asked Kheda to approach the Gauhati High Court. Now all eyes are on the final decision of the Supreme Court, which will decide whether Pawan Kheda will get relief from arrest or not.
