Pawan Kheda’s anticipatory bail approved by Supreme Court

Bureau Prayagraj. The Supreme Court has given anticipatory bail to Congress leader Pawan Kheda, giving a big relief. The court made it clear that the personal liberty of an individual, which is protected under Article 21 of the Constitution, cannot be easily endangered. The court directed that in case of arrest in Crime Branch Police Station case number 04/2026, Pawan Kheda should be released on anticipatory bail.

After the hearing held on April 30, 2026, Justice J.K. Maheshwari and Justice A.S. Chandurkar’s bench had reserved its decision after hearing the arguments of both the sides. The court also acknowledged that allegations and counter-allegations have been made by both the parties, Pawan Kheda and Rinki Bhuyan Sarma, wife of Assam Chief Minister Himanta Biswa Sarma, but no one’s freedom can be tampered with.

Actually, this case was registered against Pawan Kheda regarding the statement related to Rinki Bhuyan Sarma. Pawan Kheda had alleged that he had more than one passport and owned properties abroad. On the basis of this statement, a case was registered against him, after which he started a legal battle for anticipatory bail.

The Supreme Court has also set many conditions while granting anticipatory bail. Pawan Kheda will have to cooperate fully in the investigation and will have to be present when called by the police. They will not be allowed to tamper with the evidence in any way and will not be able to leave the country without the permission of the competent court. The court also said that the trial court can impose additional conditions as needed.

Also, the court clarified that the documents and facts mentioned while considering the bail will have no bearing on the final decision of the case and the trial court will proceed further as per law without being influenced by these observations.

Earlier, Pawan Kheda had filed petitions for anticipatory bail in Assam’s lower court and Guwahati High Court, but he did not get relief from there. After this he reached the Supreme Court. Earlier, the Telangana High Court had granted him interim bail for a week, on which the Supreme Court had stayed and directed him to approach the Gauhati High Court for anticipatory bail.
