The Taliban has published a new family law related to marriage, divorce and child marriage in Afghanistan. Human rights activists say these rules further heighten concerns about consent and women’s freedom under Taliban rule. Girls’ silence will be considered as consent for marriage

According to Afghan outlet Amu TV, rules related to child marriage, missing spouses, forced separation, apostasy, adultery allegations and other religious and legal matters are outlined. One of the most controversial provisions states that the silence of a “virgin girl” after attaining puberty can be considered as consent to marriage. However, the rule says that the silence of a boy or an already married woman will not automatically be considered as consent.

Other relatives also allowed to arrange marriage

This new law implemented by the Taliban gives wide rights to fathers and grandfathers in the matter of child marriage. If the marriage of a minor is arranged by relatives other than his father or grandfather, the marriage may still be considered legally valid if the spouses are socially compatible and the dowry is reasonable. The decree also mentions “Khiyar al-Bulugh” or “option upon attaining puberty”, which is a concept in Islamic jurisprudence whereby a child married at an early age can seek annulment of the marriage after attaining puberty.

Strictness on girls’ education

Girls in Afghanistan are denied education beyond the sixth grade, women are barred from entering universities, and there are severe restrictions on employment, travel, and public participation. Many international organizations have described the Taliban’s policies as a system of “gender discrimination”. According to Girls Not Brides, nearly a third of Afghan girls are married before the age of 18.
