Naga Chaitanya personality rights case: Veteran South Cinema actor Naga Chaitanya has received interim relief from the Delhi High Court in a major case. While hearing the case related to violation of his personality rights, the court has put an interim ban on the use of his name, face and voice without permission. The actor had approached the court regarding misuse of his identity in digital platforms, merchandise listings, AI-generated content and online videos.

Actors reach court regarding porn websites and deepfakes

This case was heard by the bench of Justice Jyoti Singh. Senior advocate Vaibhav Gaggar, appearing for Naga Chaitanya, told the court that many websites are using the actor’s name with extremely objectionable and obscene search terms to increase traffic. Apart from this, the court was also shown some merchandise which was being sold indiscriminately using the actor’s name and face without his permission.

According to reports, the petition also alleges that Naga Chaitanya’s identity is being misused commercially through pornographic websites, AI generated images, deepfake videos and defamatory content. Taking a tough stand on all these allegations, Delhi High Court has issued summons to the defendants and sought their answers.

Fake content on personal life and mention of YouTube

In the petition, Naga Chaitanya has also expressed deep concern over the morphed content and defamatory videos going on the internet regarding his personal life. Social media platform ‘YouTube’ was also present during the hearing, as the issue of such objectionable content being hosted on YouTube also came up in the court.

Along with this, the actor has also demanded dynamic injunction. This is a legal means under which if a website, even after being blocked, uploads the same content again through a new URL or mirror website, then it is automatically banned. It is considered very effective in cases of online piracy and infringement.

There will be a big debate on celebrity rights in this era of AI.

After filing the replies of the defendants, the court will now hear the case further. The court will closely examine to what extent a public figure in the digital world should be afforded legal protection against online abuse, misuse of AI and commercial use without permission.

This case has come at a time when in recent times many Indian celebrities have moved courts against their personality rights and deepfakes. Even before this, Delhi High Court has given such decisions in favor of some other celebrities, which clearly shows that the law is now becoming strict regarding AI-generated content, fake endorsements and misuse of celebrities’ voices and faces on the internet.
