What changes for foreigners in India? MHA tightens foreigner registration rules and emergency provisions

The Ministry of Home Affairs (MHA) has notified the Immigration and Foreigners (Amendment) Rules, 2026introducing significant changes to the registration process for foreign nationals, emergency provisions and the appeals mechanism under the Immigration and Foreigners Rules, 2025.

The latest amendments are aimed at streamlining immigration procedures while strengthening regulatory oversight of foreigners staying in India. The changes come as the government continues to modernise immigration administration through updated compliance and monitoring mechanisms.

One of the most important changes relates to the timeline for registration by foreign nationals required to register under Indian immigration laws. Under the amended rules, eligible foreigners can now complete their registration at any time before the expiry of 180 days from their arrival in India.

The new provision replaces the earlier requirement, which effectively allowed registration within 14 days after the completion of the 180-day period. Officials said the revised timeline is intended to provide greater clarity and ensure timely compliance by foreign visitors and long-term residents.

However, the amendment also introduces stricter conditions for delayed registration. According to the notification, registration beyond the prescribed 180-day period will now be allowed only under emergent circumstances. Applicants seeking delayed registration will be required to provide valid reasons and supporting documentation for consideration by the competent authorities.

The revised framework also incorporates changes related to emergency situations and procedural safeguards under the immigration system. While detailed operational guidelines are expected to be issued separately, officials indicated that the amendments seek to reduce ambiguity and create a more structured process for handling exceptional cases.

Another significant component of the notification concerns the appeals mechanism under the Immigration and Foreigners Rules, 2025. The amendments are expected to provide clearer procedures for individuals seeking review of administrative decisions related to immigration compliance and registration matters.

The Immigration and Foreigners Rules, 2025, were introduced as part of a broader effort to consolidate and modernise India’s immigration framework. The rules govern registration requirements, movement regulations, compliance obligations and enforcement measures applicable to foreign nationals staying in the country.

The changes are also expected to assist authorities in maintaining better oversight of foreign nationals residing in India for extended periods.

Legal experts noted that the revised registration deadline places greater responsibility on foreign nationals to complete documentation well within the stipulated timeframe. Failure to comply could result in administrative consequences unless exceptional circumstances are established.

The notification comes amid continuing efforts by the government to strengthen border management, digital immigration systems and regulatory compliance across multiple sectors. Authorities have advised foreign nationals and institutions dealing with immigration matters to familiarise themselves with the amended provisions to ensure smooth compliance.

The Immigration and Foreigners (Amendment) Rules, 2026, have now come into force following their official notification by the Ministry of Home Affairs.
