Pakistan court’s strict stance, those guilty of gang rape of woman will get death penalty

New Delhi . The judicial process has taken an important turn in the much talked about Lahore Motorway Gangrape Case of Pakistan. The Lahore High Court has rejected the appeal of two convicts, upholding the death sentence of this heinous incident that took place in the year 2020. This decision of the court is being seen as a tough stance on serious crimes against women in Pakistan’s justice system. This matter had remained a topic of discussion at the national and international level for years.

This incident came to light in September 2020 when a woman was traveling by road with her children. The family got stuck in a deserted area due to a technical problem with the vehicle during the journey. During this time, criminals took advantage of the opportunity and committed a serious crime. The incident shocked the entire Pakistan and triggered a wide debate on women’s safety, law and order and the criminal justice system.

After the matter came to light, police and investigating agencies started action on a large scale. Modern techniques were used in the investigation, in which mobile data analysis, location tracking and forensic testing were prominent. The investigating officers identified the accused on the basis of scientific evidence and other technical evidence collected from the crime scene. Later the evidence collected was presented in the court, which the court considered important.

In March 2021, the special court had convicted both the accused on the basis of available evidence. Considering the seriousness of the crime, the court had sentenced other harsh punishments including death penalty. After this, the convicts filed an appeal in the High Court challenging the sentence. In the appeal, the defense raised questions about the credibility of the investigation and evidence and demanded cancellation of the sentence.

During the hearing in the High Court, the prosecution said that the forensic report, technical data and other evidence presented in the case clearly establish the involvement of the culprits. The court, after reviewing the arguments of both sides and the available records, found that the lower court’s decision was based on sufficient evidence. After this, the court rejected the appeal and ordered to keep the death sentence intact.

This case was not limited to just a criminal incident, but became the center of national debate regarding the safety of women and the effectiveness of the justice system in Pakistan. Following the incident, there were protests across the country and demands for strict action against crimes against women. Along with this, issues like sensitive treatment towards victims, police reforms and strengthening of legal processes were also discussed.

  • Experts believe that this decision of the High Court underlines the importance of judicial accountability and evidence-based decisions in cases of serious crimes. In the times to come, this case can be seen as an important example in the discussion related to Pakistan’s judicial system and women’s safety.
