‘Even if there is no job, we will have to bear the expenses of the wife and child…’ Delhi Saket Court said – Husband cannot run away from responsibility by claiming to be unemployed.
Delhi Saket Court: Delhi Saket Court has made a big comment on family responsibility. The court clearly said that the husband cannot escape the legal responsibility of maintaining his wife and child just by claiming to be an unemployed husband. Even if you don’t have a job, you will have to bear the expenses of your wife and child. Additional Sessions Judge Sheetala Chaudhary Pradhan, while hearing the case filed under the Domestic Violence Act, said that the husband’s plea that he is unemployed cannot be accepted. While giving the verdict, the court has directed the husband to pay alimony of Rs 6,000 every month to his son.
The whole matter is of harassment for dowry. The woman had alleged that after her marriage in February 2013, she was harassed and beaten for dowry. Was mentally harassed. Not only this, her husband did not even give her financial help to run the house and raise the child.
During the hearing in the court, it was argued on behalf of the husband that the wife is educated. Therefore, she can bear the expenses of herself and the child. Commenting strongly on this, the court said that earning capacity and actual income are two different things. However, the court said that the husband failed to prove that the wife was earning enough income to support herself and the child. The Sessions Court modified the trial court’s order and directed the husband to pay alimony of Rs. 6,000 every month from the date of the order till his son attains majority. The court made it clear in its decision that unemployment cannot be a shield to avoid legal and moral responsibilities.

In fact, in the Saket court, the woman had alleged that after her marriage in February 2013, she was harassed, beaten and mentally harassed for dowry. She was thrown out of her in-laws’ house during pregnancy. After this she is living separately with her son since 2015. The trial court had rejected the woman’s domestic violence complaint in September 2025, saying it could not prove the allegations of physical violence and economic harassment. However, the court found that the husband did not provide any financial assistance for the upbringing of his son since 2015. The court said that the father is equally responsible for the maintenance of the minor child as is the mother.
