What is collegium and how does it work?

This method of appointment of judges is unique in India. Collegium system was established in 1993 after a landmark judgment of the Supreme Court. Under this system, the five supreme judges of the Supreme Court work together. This committee appoints judges to the Supreme Court and 25 High Courts of the country. The collegium also decides on the transfer and promotion of judges.

Central government also has a role in this system. The government may send back the recommendations of the collegium for reconsideration. However, as per the rules, if the collegium presents the same name again, the government must accept it. However, the government often withholds files or does not respond to them.
