The actress has moved the Bombay High Court against alleged misuse of her photos and videos with the help of AI. He has alleged that his identity is being misused on social media and the internet, due to which both his image and privacy are being affected.
During the hearing of this case, Bombay High Court has also made an important comment accepting the seriousness of this issue. The court said that such a practical ‘takedown mechanism’ should be prepared, through which objectionable and rights-violating content can be removed, while valid and legal online content is not affected.
AI deepfakes and morphed content
According to the report of ‘Bar and Bench’, Preity Zinta has filed a petition against Google, Meta, different domain registrars and other concerned parties. In the petition, he has alleged that his photographs and videos are being tampered with using AI technology. The actress says that her identity is being misused on the internet and social media platforms. Fake videos and morphed pictures are being made using his face, which are spreading rapidly among the people. Preity Zinta has demanded from the court that an effective system should be made to remove such content and necessary legal steps should be taken to stop the misuse of her image.
Alleged fake content is spreading
In the petition, the actress has said that AI-generated deepfake videos and morphed photos are being shared using her name and face on Instagram, Facebook, YouTube and other digital platforms. He says that this kind of content can confuse the common people, because due to modern AI technology, it is becoming increasingly difficult to differentiate between real and fake content. In such a situation, the reputation and credibility of any person can be seriously affected.
‘It has become difficult to differentiate between real and fake’
Senior Counsel Venkatesh Dhond presented his side in the court on behalf of Preity Zinta. He argued that AI and deepfake technology has developed so much that it has become very difficult for common people to identify which video or picture is real and which has been artificially created. He urged the court that there should be a system of swift action in such cases, so that the content violating the rights of any person can be removed as soon as possible. The lawyer also said that this kind of content violates the personality rights, privacy and moral rights of the actress.
The name is also being misused
It has also been claimed in the petition that some websites are using the name of actress Preity Zinta to promote their content, while she has no connection with those websites or their content. The actress says that people are being misled by using her name in this way and an attempt is being made to take advantage of her popularity.
What did Google and Meta say in court?
During the hearing, the lawyers appearing on behalf of Google, Meta and other parties told the court that if Preity Zinta provides specific URLs of such objectionable content, then as per the rules, those links can be reviewed and necessary action can be taken. He said that a process can be adopted to remove content that is morphed, obscene or violates rights. However, he also requested the court not to pass any order which would have unnecessary impact on online content that is legitimate and within the scope of law.
Bombay High Court directed to make ‘takedown mechanism’
Justice Madhav, who is hearing the case, said that a practical and balanced ‘takedown mechanism’ should be developed for such cases. The court clarified that the purpose of such a system should be only to remove those photographs, videos and other digital content which violates the rights of a person.
