Mathura: Illegal tomb built on the land of Banke Bihari temple, Hindus are not able to worship despite the decision of the High Court.
About 2 acres of land in Shahpur village of Mathura district, which belongs to Banke Bihari Temple, the ancient platform of the temple is still present there. The temple was demolished during the reign of Aurangzeb but its platform is still there. The Hindu community had been performing puja here till 6 years ago. Sages and saints also lived here. There was also a cowshed, there was an amphitheater and a well in this area of the temple. But in 2004, Bhola Kahan Pathan, a leader of the then state government party, secretly prepared fake documents for the temple. On the basis of papers, the entire land of the temple complex was declared as a graveyard.
This is how the whole matter came to light
The matter came to light when the Muslim community tried to siege it in 2019. They also tried to destroy the evidence of the temple with JCB. A tomb was forcibly built on the platform of the sanctum sanctorum of Banke Bihari. From that time onwards tension started between the two communities. However, the Muslim community could not completely take possession of the land because a legal battle had started. At the same time, from ancient times till now, the land is registered in the name of Thakur Banke Bihari Mandir in all the papers, be it the land deed or other revenue registers, the temple is registered in all the documents.
Hindu community has not been able to perform puja here since 2019
When the matter reached the High Court, the High Court’s decision came in favor of the temple in 2023. Even in the police report, there is mention of a temple and a platform, not of any kind of graveyard or tomb. Today the entire complex has been converted into a forest and PAC is deployed for guarding. The Hindu side has all the documentary evidence. Since 2019, the Hindu community has not been able to perform worship here. From Tehsildar to Collector and the court, everyone’s decision is in favor of the temple but till now the Hindus have not been able to get the possession. The illegal tomb has also not been removed yet.
Vakt Board also rejected the claim of Muslim side
The elders of the village say that saints used to live here earlier. There was worship every day. There used to be a market here but now there is nothing. Even the Time Board has clearly stated in writing that this land is not registered with them as a cemetery. Despite all the evidence, witnesses and decisions, the situation remains the same.
