SC News: Way cleared to shift Uttarakhand High Court to Haldwani, Supreme Court gives important decision
SC News: Amidst the long running debate regarding Uttarakhand High Court, the Supreme Court has given an important decision. The court made it clear that administrative matters like shifting the High Court from Nainital to another place cannot be decided through referendum. The court said that it was not appropriate to give such an order during judicial proceedings. Along with this, the Supreme Court canceled the order of Uttarakhand High Court, in which it was said to hold a referendum.
Big decision came on the petition of Bar Association
This matter had directly reached the Supreme Court on behalf of the Uttarakhand High Court Bar Association. The Bar Association said that such an order is not in accordance with the legal procedure. While hearing the case, the Supreme Court heard the arguments of all the parties and then gave its decision. Courts should remain within the limits of jurisdiction
During the hearing, Chief Justice Surya Kant said that sitting on the judicial side and giving such administrative instructions does not come under the jurisdiction of the High Court. He said that the courts should follow the limits of their rights and responsibilities. Therefore, that order of the High Court cannot stand and is cancelled.
The problem will be solved through mutual coordination
The Supreme Court also said that issues like infrastructure and building construction related to the High Court should be decided at the administrative level. The court suggested that the Uttarakhand High Court and the state government sit together in coordination and find a solution to these issues, so that judicial work is not affected in future and necessary facilities are available on time.
Court expressed satisfaction over land being identified in Haldwani
During the hearing, information also came to light that the state government has already identified land for the construction of a new High Court building in Haldwani district. The Supreme Court expressed satisfaction on this and said that now there should be no unnecessary delay in taking this process forward. The court stressed on completing all the necessary approvals within the stipulated time.
State government got 6 weeks time
The Supreme Court directed the state government to complete the necessary administrative and legal formalities within 6 weeks. After this, the identified land should be handed over to the High Court, so that the construction work can proceed. The objective of the court is to ensure that better infrastructure facilities are provided for the judiciary keeping in mind the future needs.
