Prayagraj. Allahabad High Court has said important things regarding school uniform and hijab. A Muslim student from Prayagraj had filed a petition in the Allahabad High Court regarding permission to wear hijab along with uniform in school. Hearing this petition, the bench of Justice JJ Munir and Justice Inderjit Shukla of Allahabad High Court said that it is necessary to follow the rules related to school uniform. Under this rule, wearing hijab cannot be approved on individual basis.
Allahabad High Court clearly said that no student has the legal right to change or add additional attire as per personal choice in the dress code prescribed by any educational institution. The Allahabad High Court bench said that as long as the school uniform is fair, non-discriminatory and maintains the discipline and equality of the institution, it has complete autonomy to enforce discipline and dress code within the institution. The Allahabad High Court said that any unaided private educational institution that imposes uniform has every right to do so and maintain discipline. Allahabad High Court said that it is necessary to wear the prescribed uniform in school. There is no legal right to be allowed to wear a scarf with it on a personal basis.
The Allahabad High Court clearly said that if uniform is applicable equally to all students and permission is given to discriminate against any community or individual or decide on the basis of choice, then it will be against the very idea of uniform. The court said that by doing this the right to decide school discipline would go to individual students instead of the institution. The court also said that in whichever state the issue was raised, the High Court of that place has had the same opinion that wearing hijab for women in Islam is not an essential part of the religion. Religion will not be in danger by not wearing hijab. The court said that no such evidence was presented to prove that wearing a headscarf is an essential part of the religion for a Muslim woman. If the woman does not believe this, she will be thrown out of the religion.
