In the voter list case related to Congress leader Sonia Gandhi, the Delhi court has canceled the old order of the Magistrate Court and directed for re-hearing of the case. This case pertains to a complaint alleging that Sonia Gandhi’s name was recorded in the voter list of 1980 before she acquired Indian citizenship. The Court held that the order dismissing the complaint lacked sufficient reasons and sent the case back for fresh consideration.
Court raised questions on magistrate’s order
Dwarka Court Special Judge Vishal Gogane quashed the order passed by the magistrate. According to the court, the lower court order did not provide sufficient reasons for deciding on the complaint. The court considered this as a kind of ‘non-speaking order’.
Now the complaint will be heard afresh
The sessions court has sent the case back to the magistrate court. Now the allegations made in the complaint, available records and legal aspects will be heard again. After this the magistrate will have to pass a new order with reasons.
Comments were also made on the issue of citizenship
The court also took exception to some of the magistrate’s observations regarding jurisdiction related to citizenship. The court said that even in the case clear reasons were not recorded regarding disclosure of cognizable offence. Also, questions were raised on the comments of the lower court regarding the citizenship related findings related to the Central Government and the Election Commission.

Next hearing of the case after court order 29 September 2026 Has to happen. On that day, the magistrate court will hear the case afresh and a decision will be taken on further proceedings.
What is the whole matter?
The case pertains to a complaint alleging that Sonia Gandhi’s name Voter list of New Delhi parliamentary constituency, 1980 He was registered in India, while he got Indian citizenship in 1983. The complainant had demanded registration of FIR and investigation on this basis. The magistrate court had rejected this demand in September 2025, against which a revision petition was filed.

What does court order mean?
The current order means that the earlier magistrate’s order dismissing the complaint will no longer be effective and the case will have to be heard again. This order itself does not prove the allegations nor is it a finding of any offense against Sonia Gandhi. The next decision in the case will be known only after further legal process and a fresh hearing by the magistrate.
