UP News: The effect of Chief Minister Yogi Adityanath’s sensitive administrative thinking and clear policy regarding conservation of government land is now visible even in old pending cases. A case of Nazul land pending for about 30 years in Devipatan division has reached a new turn due to the activeness and effective monitoring of the administration.
Amidst the continuous review, monitoring and effective advocacy of Divisional Commissioner Durga Shakti Nagpal, the plaintiff in the case has given an affidavit in the court requesting not to pursue further litigation and the proceedings should be ended. Along with this, the concerned party itself has removed its 30 years old possession from the government land.
Campaign to free government land from encroachment
This case is related to Nazul plot numbers 514, 515, 524 and 525 reserved for the Divisional Commissioner’s office and building in Gonda. The case was pending in the court since 1997. Even after the stay order was passed in 2008, legal advocacy in the case continued. This old incident came to the notice of the administration during the campaign to free the government land from encroachment, after which Devipatan Divisional Commissioner Durga Shakti Nagpal started the review again.
No student or teacher found in illegally run school
After information about the old Nazul land issue came to light, Divisional Commissioner Durga Shakti Nagpal continuously reviewed the matter. The records and court situation were investigated. Besides, instructions were given to the concerned officers for effective legal advocacy to present the government’s position strongly and protect the government’s interests. During the investigation, it also came to light that an illegal school was being run on the land. When the administration investigated the situation at the spot, no student or teacher was found there at present. After this, the actual condition of the land was also monitored.
Plaintiff/encroacher retreated in court, also removed possession from the spot
In the case, an affidavit was presented in the court on behalf of the plaintiff/encroacher Dayanand Mishra. In this he has requested not to pursue the case further and the proceedings should be ended. The important thing about the case is that the concerned party, along with withdrawing from the legal advocacy in the court, also withdrew its possession from the spot. In this way, on the one hand, there was a change at the level of the court process in the dispute pending for almost three decades, while on the other hand, the physical condition of the land also changed.
The case started in 1997, now the land is free from encroachment
The dispute, which started in 1997, has been in court for almost three decades. The case remained pending even after the stay order of 2008. Now in the year 2026, after the affidavit of the plaintiff and removal of possession from the site, the administration has the responsibility of keeping these plots safe. Divisional Commissioner Durga Shakti Nagpal said that action will be taken towards keeping these plots reserved for Devipatan Commissioner’s office and building safe and ensuring their use for the prescribed government purpose.

He said that under the priority of Yogi government for administrative efficiency and protection of government properties, old and pending cases are also being reviewed. In this sequence, the file of this three decade old Nazul land case was reopened and along with the judicial situation, the actual situation of the spot was also examined. After the action taken under the supervision of Divisional Commissioner Durga Shakti Nagpal, now the focus of the administration is on ensuring the security of these plots and their prescribed government use. This episode shows that government interests can be protected through regular review of long pending cases, strong advocacy and administrative monitoring.
