Madhya Pradesh Police Headquarters has issued new guidelines to the heads of all its police units to confiscate the movable and immovable property of absconding accused. It has been said in the guidelines issued that a person for whom an arrest warrant has been issued by the court and has absconded or has gone into hiding to avoid his arrest, should be issued a proclamation from the court to appear before the court and after its due service, if he does not appear before the court by the date given in the proclamation, then the court can order confiscation of the property of such person.
For confiscation, the property of the accused person should be identified in such a way that information regarding the immovable property of the accused be obtained from the Revenue Department. Get information about the land/building from the office of Gram Panchayat Secretary, Municipal Body, Sub Registrar etc. regarding his residence and where the property of the accused has been found.
By obtaining the details of the bank accounts of the accused, using the funds deposited there and PAN card number and other personal information, find out the shares, debentures, bonds and such movable assets in the name of that person. Get information regarding his ITR from the Income Tax Department. Get information about purchasing vehicle in his name from the transport department.
