Delhi High Court on Wednesday rejected the petition challenging the results of Delhi University Students Union (DUSU) elections. The petition alleged large-scale irregularities during the elections. University officials were also accused of campaigning in favor of ABVP. This petition was filed by NSUI candidate Vijay Shankar Meena. Meena had contested the election for the post of DUSU President. He challenged the election process and results and demanded cancellation of the election results.
Allegations not proved on the basis of photographs
During the hearing, the petitioner's lawyer presented some photographs before the court in support of his allegations. Through these photographs, an attempt was made to prove the allegations of alleged irregularities in the elections and university officials campaigning in favor of ABVP. However, the Delhi High Court said that these photographs alone do not prove that the people seen in them were associated with Delhi University or were campaigning in favor of any candidate during the elections.
The petitioner's counsel had presented some photographs before the court in support of the allegations. However, according to Live Law report, the court said that there was no date recorded on the photographs and necessary information related to them was also not provided. In such a situation, allegations made on the basis of photographs alone cannot be considered. The court also said that the alleged people seen in the photographs were not even made parties to the petition. According to the court, it could not be clarified when the incident shown in the photographs took place and who were the people seen in it.
Also cited the recommendations of Lyngdoh Committee
The petitioner also cited the recommendations of the Lyngdoh Committee regarding university and college student union elections. However, the court said that the facts necessary to implement these recommendations in the present case were not adequately set out in the petition. The Court specifically noted that the petitioner had not been able to clarify the date and time of the alleged incident shown in the photographs.
University said- will decide on the complaint soon
During the hearing, the lawyer appearing for Delhi University told the court that the university will take a decision as soon as possible on the complaint given by the petitioner four days ago. The court took this statement of the university on record and after this disposed of the petition.
Election results were declared on September 19
The petition sought to cancel the DUSU election results declared on September 19. Yash Dabas of ABVP was victorious in the election for the post of President. He got 24,576 votes, while NSUI candidate Vijay Shankar Meena got 22,523 votes. There was a difference of 2,053 votes between the two candidates. Meena had challenged the result alleging irregularities in the election process and university officials of campaigning in favor of ABVP.
What allegations were made?
The petition alleged that some principals, professors and election officials of Delhi University and its affiliated colleges campaigned in favor of ABVP candidates. The petitioner claimed that this affected the fairness of the DUSU elections. The petition also sought to preserve CCTV footage of five colleges to preserve election-related evidence. Apart from this, allegations of alleged irregularities in voting percentage were also made. The petition specifically alleged that Ankit Sangwan and Mohit Dahiya, who were appointed election officers at Satyawati College, had campaigned in favor of ABVP candidates before the voting. On the basis of these allegations, the petitioner had sought investigation into the election process and cancellation of the results declared on September 19.
