A bench of Chief Justice (CJI) Surya Kant, Justice Joymalya Bagchi and Justice V Mohana heard the petitions on Monday. The bench clubbed the case with another petition against Gyanesh Kumar.
In the court, lawyer Vikas Singh said that the authority of the Election Commission has been increased by the 2023 Act. Some interim measures are needed. The credibility of the commission has reduced so much that every citizen is feeling unsafe. Vikas Singh demanded suspension or withdrawal of the powers of Chief Election Commissioner Gyanesh Kumar till the completion of the hearing.
Advocate Maneka Guruswamy, appearing for the petitioner, said that the voting rights of the citizens are in danger and the CEC is biased.
In another related petition, Maneka Guruswamy raised questions on the changes made in 'Form 6' and alleged major flaws in the SIR process. Maneka Guruswamy said in the court that we have seen fair and free elections in this country. Today the situation is not like that. This is a national problem.
The bench questioned Maneka Guruswamy about the demands made in the petition, but she said that she stood by her demands.
Following this, the Supreme Court refused to pass an interim order on a petition seeking suspension of Chief Election Commissioner Gyanesh Kumar. Also, on Monday, a bench headed by CJI Surya Kant issued notice to the Election Commission, Chief Election Commissioner Gyanesh Kumar, Election Commissioner Sukhbir Sandhu and Election Commissioner Vivek Joshi besides the Central Government on the petition.
