New Delhi. While hearing the petition of the Central Government in the matter of appointment of DGP in Jharkhand, the Supreme Court has issued a notice to the Jharkhand government and the current DGP Tadasha Mishra and sought their reply. The apex court raised questions on the rule related to the appointment of DGP in Jharkhand. The Supreme Court says that the rule of Jharkhand, under which an IPS officer can be appointed DGP even if he has less than six months left in his tenure, is prima facie against the Prakash Singh judgment given earlier by the court.

The Supreme Court has given one week's time to the Jharkhand government to reconsider this rule or file a reply regarding it. Along with this, the court has also asked the amicus curiae (friend of the justice) to investigate the laws related to the appointment of DGP in other states. Justice Joymalya Bagchi said that our concern is not whose government is at the Center or in the state. Our main duty is to ensure that the rules and regulations laid down by this Court are not violated. The court has also given Tadasha Mishra a chance to file her reply because if the rule is cancelled, it will affect her appointment.

In fact, on December 29, 2025, the Jharkhand government had abolished the condition of six months of minimum service remaining for the appointment of DGP by amending the rules of the year 2025. A day after this, on December 30, 2025, senior IPS Tadasha Mishra was made DGP. According to the Home Ministry, Tadasha Mishra was scheduled to retire on December 31, 2025. The government has challenged this decision of the Jharkhand government. Apart from this, the Central Government has also raised questions regarding the appointment of former Jharkhand DGP Anurag Gupta.
