Delhi High Court On Delhi SIR: Delhi High Court has given a big relief to the voters who were left out of the voter list during the Special Intensive Revision i.e. SIR in the country's capital Delhi. Delhi High Court has given permission to the voters left out of the voter list to fill Form-6. The court clarified that the fear of action on charges of 'false declaration' on filling Form-6 is baseless. The court described the apprehension of the petitioners as a misunderstanding, in which they feared that legal action could be taken on the charges of 'false declaration' on submitting Form-6.
The bench of Justice Dinesh Mehta and Justice Aditi Chaudhary clarified that on the instructions of the Election Registration Officer, the Election Commission's lawyer had suggested filling Form-6. Therefore the fear of action is completely baseless.
In fact, the names of the petitioners were removed from the voter list due to shift from the old address and non-completion of the enumeration form during the SIR process. According to the rules, Form-6 is generally used for registration of new voters i.e. Fresh Inclusion. In this, the applicant has to prove that he is getting his name added for the first time and his name has not appeared in the voter list anywhere before.
The petitioners feared that despite being already a voter, they could face a case of false declaration if they filled Form 6, because their name was in the voter list before SIR and they had also cast their vote. The Delhi High Court clarified that the petitioners can apply for re-addition through Form 6 on the official website of the Election Commission or the portal of the Chief Electoral Officer of Delhi without any fear.
