Karnataka High Court Verdict In Road Accident Case: Case will be filed against father of minor car driver, Karnataka High Court refuses to give relief, three people lost their lives in the accident

New Delhi. The Karnataka High Court, while hearing a case related to a road accident, has refused to quash the proceedings of culpable homicide against the father of a minor car driver. Karnataka High Court judge said that the steering of a car cannot become a toy in the hands of a child. Actually, this man allowed his minor son to drive the car and he hit the couple and their minor child at high speed, killing all three. This incident of accident took place in December 2020 on the old Bengaluru-Mysore road.

Mysore resident petitioner Nadeem-ur-Rahman had filed a petition in the Karnataka High Court challenging the lower court's decision. The lower court has ordered initiation of proceedings against Nadeem for culpable homicide. Nadeem told in the court that without his knowledge his minor son silently drove away with the car. While the defense lawyer argued in the court, he said that this case of accident cannot be seen as culpable homicide. The government lawyer said in his argument that the facts on record show that the father himself had handed over the keys of the car to his minor son.

After hearing the arguments of both the parties, Justice M. Nagaprasanna said that parents who allow their minor children to drive cannot escape their responsibility after a major disaster under the guise of their child being a minor. Parents have to understand their responsibilities. Justice Nagaprasanna said that the minor's father was refused relief from the proceedings of culpable homicide. Justice Nagaprasanna, while delivering his verdict, also shared the statistics of road accidents caused by minors.
