Democrats Seek Limits on Federal Election Actions

Democratic Party leaders have sued the Trump administration in federal court, seeking to prevent it from taking over responsibilities they say belong to state election authorities.

Filed Tuesday in Washington, the lawsuit comes roughly two weeks before the Nov. 3 midterm elections.

The plaintiffs accuse the administration of attempting to pressure state and local election officials into complying with unlawful demands. They are asking the court to prohibit those actions and protect legally registered voters’ access to the ballot.

Lawsuit Seeks Protection Against Voter Removals and Ballot Denials

The complaint requests an order barring the administration from purging legally registered voters from statewide registration lists or denying them ballots.

Sen. Chuck Schumer, Rep. Hakeem Jeffries and the other plaintiffs also seek a ruling that the administration unlawfully threatened state election officials with prosecution ahead of Election Day.

Those claims are allegations presented in the lawsuit, rather than findings already issued by the court.

California Mail Ballot Case Cited in Complaint

The Democratic lawsuit points to the Justice Department’s recent actions in California as an example of the federal intervention it seeks to stop.

In that case, the department sued to prevent state officials from counting mail-in ballots submitted by people the federal government identified as “likely” noncitizens until their immigration status could be verified.

That designation does not itself establish that the affected voters are noncitizens.

The Democratic plaintiffs argue that the administration has used unsupported election fraud claims to justify expanding federal control.

“For over a decade now, President Donald J. Trump has bombarded the American people with lies and misinformation about American elections and voter fraud,” the complaint says. “While these lies have been debunked at every turn, that has never deterred the President from employing them as a pretext to seize control over elections, even as courts overwhelmingly reject that effort.”

Justice Department Defends Election Integrity Efforts

The Justice Department said election integrity remains a top administration priority.

In a statement, the department maintained that its election-related actions are grounded in law and are being litigated in court.

Its response disputes the Democratic plaintiffs’ characterization of those efforts as an unlawful intrusion into election administration.

Boasberg Assigned Case Against Trump and Federal Agencies

The lawsuit was assigned to Chief Judge James Boasberg, who has faced White House criticism over rulings against the administration during Trump’s second term.

Alongside Schumer and Jeffries, the plaintiffs include the Democratic Senatorial Campaign Committee, the Democratic Congressional Campaign Committee and the Democratic Governors Association.

The named defendants are Trump, the Justice Department, Attorney General Todd Blanche, the Department of Homeland Security and Homeland Security Secretary Markwayne Mullin.

The plaintiffs are seeking court intervention as state and local officials prepare to administer the midterm elections.
