In Delhi-NCR, criminals often escape from the grip of law by taking advantage of the state borders. For example, a criminal commits a crime in Delhi and escapes to Noida, while another commits a crime in Ghaziabad and goes to Gurugram. It becomes challenging to catch criminals in such areas divided into different states. The Supreme Court advised the Central Government to create such a system so that a single agency can take action against organized crime in the entire NCR – Delhi, Noida, Faridabad, Gurugram without any hindrance and the accused can be produced in a special court.

According to the report, Chief Justice of India Surya Kant told Additional Solicitor General Aishwarya Bhati, “Why can’t one law be made for the entire National Capital Region? Like central laws like UAPA, PMLA and NDPS Act, set up special courts in Delhi, Gurugram or Noida, where crimes committed under central laws can be tried, irrespective of the place of crime.” Through this suggestion, he stressed the need for a uniform and effective legal system against organized and cross-border crimes in NCR.

Reviewing the progress of the Center and states towards setting up special dedicated courts to hear cases investigated by the National Investigation Agency (NIA), a bench of CJI Surya Kant and Justice Joymalya Bagchi outlined the modus operandi of the criminals. The court said that criminals often commit crimes in one state and flee to another state, so that arrest and trial can be delayed and bail can be obtained by taking advantage of the delay.

Justice Bagchi said, “If a gangster commits 10 crimes in Haryana, 5 in Rajasthan and 2 in Delhi, the NIA can be asked to investigate and a special law can be invoked to trial the accused in a court in NCR.” Additional Solicitor General Aishwarya Bhati advised the court that the Supreme Court can take suo motu cognizance of this issue and prepare a framework. On this, the bench said that this comes under the legislative process and Parliament or the respective state governments can take steps in this direction.

In its order, the bench said, “In cases involving serious crimes, members of organized criminal gangs take unfair advantage of the jurisdictional issues in NCR. It is necessary for prompt police action to have a competent court at one place where such criminals can be tried. In its absence, trials at different places lead to delays and notorious criminals get the benefit of bail, which cannot be in the interest of the society and public. It is necessary to deal with such cases and have the best legal framework.” It is desirable to make an effective law for the use.”
