Aadhaar–PAN linking mandatory, but these individuals are exempt under Income Tax rules

Linking Aadhaar with PAN is mandatory for most taxpayers in India, but not everyone is required to comply. Introduced under Section 139AA of the Income Tax Actthe Aadhaar–PAN linking rule aims to eliminate duplicate PANs, improve transparency, and strengthen financial tracking.

Since the deadline for linking has already passed, there is widespread confusion over who must link Aadhaar and PAN and who is legally exempt. The Income Tax Act clearly defines specific categories of individuals who are not required to complete the linking process.

Who is exempt from Aadhaar–PAN linking?

As per Income Tax rules, the following individuals are exempt from mandatory Aadhaar–PAN linking:

  • Non-residents as defined under the Income Tax Act, 1961
  • Individuals aged 80 years or above (super senior citizens) at any time during the previous financial year
  • Residents of Assam, Meghalaya, and Jammu & Kashmir
  • Individuals not eligible to obtain Aadhaarincluding certain foreign nationals

Aadhaar eligibility is a key condition. If an individual is not required to have AadhaarPAN linking is not mandatory. However, if Aadhaar has been obtained voluntarilylinking becomes compulsory, failing which the PAN may be rendered inoperative.

Rules for NRIs and foreign nationals

Non-Resident Indians (NRIs) are not required to link PAN with Aadhaar if they do not possess an Aadhaar number. Foreign nationals and non-citizens are also exempt, though PAN remains mandatory for income earned or investments held in India.

Special cases: seniors, minors, joint holders

Minors holding a PAN are not required to link Aadhaar until they turn 18. Once they become adults, linking becomes mandatory. In joint bank or demat accounts, each individual PAN must be linked separately to avoid operational issues.

In the case of deceased individuals, Aadhaar–PAN linking is not required. Families are advised to surrender the PAN through official channels.

What happens if PAN is not linked?

For individuals who are required to comply but fail to do so, PAN becomes inoperative. However, PAN can still be reactivated by completing Aadhaar linking with a penaltyeven after the deadline.
