Justice Suryakant pointed out that many lawyers are now directly using AI tools to prepare pleadings and legal documents. However, it often contains very inaccurate, incomplete and completely fictitious information. Most shockingly, some of the petitions refer to court judgments that never actually existed. AI often creates false references on its own, which not only wastes valuable court time, but also calls into question the credibility of the entire judicial process.

During the hearing, the bench explained that some lawyers are submitting the draft prepared by AI directly to the court without checking the facts. Expressing displeasure, the judge said, “The primary responsibility of a lawyer is to verify the veracity of every fact and context. The use of AI may be limited to research assistance, but it cannot replace the lawyer’s discretion and responsibility.”

The court further noted that artificial intelligence lacks the ability to analyze situations and retain human senses. Judging is not just based on rules, it involves experience, senses and conscience, which a machine can never possess.

Deterioration of intellectual capacity and a stern warning to lawyers

Justice Suryakant has warned that the court will not hesitate to take strict action if such AI-generated false pleas continue to be filed in future. Technology is only useful for searching old results or managing documents. However, the entire responsibility of final argument and presentation of facts shall rest solely with the counsel.
